Terms and Conditions

1. Acceptance of Terms

By accessing or using the PredictorSDK API, SDKs, documentation, or any related services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

If you do not agree to these Terms, do not use the Service.

2. Description of Service

PredictorSDK provides a unified API and software development kit (SDK) that aggregates real-time market data from third-party prediction market exchanges, including but not limited to Kalshi, Polymarket, SX.Bet, Predict.fun, Hyperliquid, AlphaArcade, and ProphetX. The Service enables developers and businesses to access normalized market listings, live odds, order book data, WebSocket streams, and related data across multiple prediction market platforms through a single integration.

3. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and that your use of the Service complies with all applicable laws and regulations in your jurisdiction, including those governing prediction markets and financial data in your region.

4. Account Registration and Authentication

To access the Service, you must create an account. Account registration and authentication is handled through Clerk, a third-party identity and authentication provider. By registering, you also agree to Clerk's terms of service and privacy policy.

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activity that occurs under your account
  • Notifying PredictorSDK immediately at nick@predictorsdk.com of any unauthorized use of your account

PredictorSDK reserves the right to suspend or terminate accounts that provide inaccurate information or violate these Terms.

5. API Keys

API keys are issued and managed through Unkey, a third-party API key management provider. By using the Service, you agree to Unkey's terms of service.

You are solely responsible for:

  • Keeping your API keys confidential and secure
  • All API usage associated with your keys
  • Revoking and replacing any keys you believe have been compromised

Do not embed API keys in publicly accessible code, repositories, or client-side applications. PredictorSDK is not liable for unauthorized usage resulting from compromised keys.

6. API Usage and Restrictions

6.1 Usage-Based Billing

The Service uses a tiered billing model that may include free prototype access, paid subscriptions, included monthly usage allowances, and metered overage. Current plan scope and pricing are published on our pricing page and may change with notice.

6.2 Permitted Use

You may use the Service to build applications, tools, and integrations that access prediction market data for lawful purposes.

6.3 Prohibited Use

You may not:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
  • Resell, sublicense, or redistribute raw API access or data feeds without written permission from PredictorSDK
  • Attempt to reverse engineer, decompile, or extract the underlying source code of the Service
  • Use the Service to manipulate, interfere with, or disrupt any prediction market exchange
  • Cache or store data beyond what is reasonably necessary for your application's functionality
  • Use the Service in any manner that places undue burden on our infrastructure or circumvents rate limits
  • Use the Service to facilitate illegal gambling or wagering where prohibited by law
  • Share, transfer, or resell your API keys to third parties

6.4 Rate Limits

PredictorSDK may impose rate limits on API usage at any tier. Exceeding rate limits may result in temporary throttling or suspension of access. Higher usage tiers are available through paid plans.

7. Fees and Payment

7.1 Free Tier

Certain endpoints, request volumes, or usage modes may be available at no charge. PredictorSDK reserves the right to modify free-tier scope or limits at any time with reasonable notice.

7.2 Paid Usage

Paid plans may include subscription fees plus metered overage based on usage. Payments are processed through Stripe, a third-party payment processor. By providing payment information and subscribing to a paid plan, you agree to Stripe's terms of service and authorize PredictorSDK to charge your payment method for fees incurred under that plan.

7.3 Billing Cycle

Usage is calculated and billed on a monthly basis. Invoices and billing history are accessible through your account dashboard.

7.4 Disputes

If you believe you have been incorrectly charged, you must notify PredictorSDK within 30 days of the charge by contacting nick@predictorsdk.com. PredictorSDK will review disputed charges in good faith.

7.5 Taxes

You are responsible for all applicable taxes associated with your use of the Service.

8. Third-Party Data and Services

The Service aggregates data from third-party prediction market platforms. PredictorSDK does not guarantee the accuracy, completeness, or timeliness of data sourced from third parties. Your use of data obtained through the Service may also be subject to the terms of service of the underlying third-party platforms.

PredictorSDK relies on the following third-party providers to deliver the Service:

  • Clerk — User authentication and identity management
  • Stripe — Payment processing
  • Unkey — API key issuance and management
  • Resend — Transactional and product email delivery

PredictorSDK is not affiliated with, endorsed by, or sponsored by Kalshi, Polymarket, SX.Bet, Predict.fun, Hyperliquid, or any other third-party platform whose data is accessible through the Service.

9. Data Collection and Privacy

9.1 Developer Data

PredictorSDK collects information from developers and businesses who register for the Service, including name, email address, payment information, and API usage data. This data is used to operate, maintain, and improve the Service.

9.2 End User Data

If you build applications using the Service that are accessed by your own end users, you are solely responsible for ensuring your collection and handling of end user data complies with all applicable privacy laws, including GDPR and CCPA where applicable. PredictorSDK does not knowingly collect personal data from end users of applications built on our platform.

9.3 Privacy Policy

Use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Intellectual Property

10.1 Our IP

PredictorSDK retains all rights, title, and interest in and to the Service, including all intellectual property rights. These Terms do not grant you any rights to use PredictorSDK's trademarks, logos, or branding.

10.2 Your IP

You retain ownership of any applications or products you build using the Service. By using the Service, you grant PredictorSDK a limited license to use anonymized, aggregated usage data to improve the Service.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. PREDICTORSDK DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. PREDICTORSDK MAKES NO WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, OR TIMELINESS OF ANY DATA PROVIDED THROUGH THE SERVICE.

NOTHING IN THE SERVICE CONSTITUTES FINANCIAL, INVESTMENT, OR TRADING ADVICE. PREDICTORSDK IS A DATA AGGREGATION AND DEVELOPER TOOLS PROVIDER ONLY.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PREDICTORSDK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, TRADING LOSSES, OR BUSINESS INTERRUPTION.

IN NO EVENT SHALL PREDICTORSDK'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNTS PAID BY YOU TO PREDICTORSDK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless PredictorSDK, Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, your violation of any third-party rights, or any applications you build using the Service.

14. Termination

PredictorSDK may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately and any outstanding usage charges become immediately due. Sections 10–17 of these Terms survive termination.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

16. Changes to These Terms

PredictorSDK reserves the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
